LIMITED POWER OF ATTORNEY AND RELEASE FORM AUTHORIZATION Regarding my Medications
1. I will be the only person using my medications(s) and I will use them as prescribed.
2. I understand that my medications cannot be returned for exchange or refund.
3. I understand that Manitoba Pharmacy #32241 may substitute a generic drug for a Brand Name unless otherwise stated.
My Information
1. I am of the age of majority and I am not restricted from making my own medical decisions.
2. The medication(s) I have ordered were prescribed by a licensed doctor in the state where I reside.
3. By obtaining the prescription for my ordered product(s), I have not broken laws of that state.
4. It is my responsibility to have regular physical examinations by my U.S. licensed physician, including all suggested tests to ensure I have no medical problems that contradict my taking the prescribed medication(s).
Delivery of Medication
1. I acknowledge that Manitoba Pharmacy #32241 and agents rely on the health information and documentation that is provided by me. This includes my patient questionnaire and all other related information I forward to Manitoba Pharmacy #32241. I represent and confirm that I have, to the best of my knowledge, fully disclosed all pertinent information and documentation for my prescriptions. I agree that I will notify Manitoba Pharmacy #32241 of any changes to my physical or medical condition by providing an updated patient questionnaire.
2. I understand that when possible, my medications will be in original manufacturer’s packaging which may or may not be in child resistant packaging, and I must indicate if I choose or choose not to have child resistant packaging.
3. I name and authorize Manitoba Pharmacy #32241, as my agent and attorney for the limited purposes of taking all necessary steps and signing all related documents on behalf of myself to:
(a) obtain a prescription in Canada for the prescription sent by me as if I were personally present taking those steps and signing those documents myself, including, but not limited to, collecting my personal health information and patient questionnaire regarding me directly or from my prescribing physician or pharmacist and disclosing that information to Manitoba Pharmacy #32241's employees, as required, for the limited purposes stated in this paragraph.
(b) package or repackage the pharmaceutical medications and deliver them to myself.
(c) for shipping my prescribed pharmaceutical medication(s) as if I had shipped the prescribed pharmaceutical medication(s) to myself at my own address.
4. I acknowledge Manitoba Pharmacy #32241 to be a pharmacy located in Canada, licensed by the Manitoba Pharmaceutical Association, licence #32241, and agree that I have initiated the consultation. I also acknowledge that the Manitoba Pharmacy #32241 pharmacists and contracted physicians are located and licensed to practice pharmacy or medicine in Canada.
5. I acknowledge that the Canadian cosigning physician evaluates my medical profile and may approve my prescription but is in no position to modify my medication(s). This relationship does not replace that of my primary physician.
Release & Disputes
I, the client, attorn to the jurisdiction of Manitoba and agree that the courts in Manitoba, Canada shall hear any dispute that arises between the Client and the Providers. The provider and client hereby submit to the jurisdiction of Manitoba and agree that any dispute shall be heard by the Courts in Manitoba, Canada, including, but not limited to any claims of negligence and/or malpractice. Further, the Client agrees that the laws of Manitoba, Canada pursuant to the laws, policies and privileges of Canadian law including but not limited to the laws of Manitoba, Canada and that the Client is benefiting from such laws, policies and privileges by participating in the program.
BY AGREEING TO THIS DOCUMENT THE CLIENT CONFIRMS THAT HE/SHE HAS READ AND UNDERSTOOD THESE TERMS AND THAT THEY ARE TRUE AND CORRECT AND THE CLIENT AGREES THAT THE TERMS HEREIN ARE BINDING ON THE CLIENT AND THE HEIRS ASSIGNS, SUCCESSORS AND PERSONAL REPRESENTATIVES OF THE CLIENT.
